Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Restaurant Partner", "Merchant", or "User") and KitchenZap. KitchenZap operates as a Restaurant Operating System providing digital ordering, payment synchronization, kitchen display (KOT), counter billing, customer management, and operational software. By accessing or using our platform, dashboard, or ordering channels, you agree to comply with these Terms.
1. Scope of Technology Services & Food Responsibility
KitchenZap is strictly a technology software provider. KitchenZap is NOT a food manufacturer, caterer, restaurant, or courier delivery service.
- The Restaurant Partner retains exclusive responsibility for food preparation, freshness, culinary hygiene, food safety, packaging, allergen disclosures, dietary labels, and compliance with FSSAI regulations.
- To the maximum extent permitted by applicable law, KitchenZap disclaims liability for food quality grievances, health code violations, food allergies, delivery transit delays, or inaccuracies in merchant menu pricing.
2. Prepaid Wallet & Value-Slab Platform Fees
KitchenZap operates on a prepaid wallet model with transparent, pay-per-accepted-order usage charges without mandatory fixed monthly software subscriptions:
First Wallet Recharge: Restaurant onboarding begins with an initial prepaid wallet recharge of ₹2,500. This is not a setup fee, onboarding charge, or installation fee. The full ₹2,500 is credited to the restaurant's KitchenZap wallet balance and is drawn down solely for applicable per-accepted-order platform fees.

* Platform fees are deducted only when an order transitions to ACCEPTED state. Orders rejected or cancelled prior to kitchen acceptance incur exactly ₹0 platform fee. Third-party provider costs (such as payment aggregator MDR or Meta WhatsApp conversation charges where enabled) are separate and not included in KitchenZap platform fees.
3. Acceptable Use & Messaging Policies
When utilizing KitchenZap communication channels (including optional WhatsApp features), merchants must adhere to applicable messaging policies and laws:
- Sending unsolicited bulk marketing blasts, deceptive content, spam, or abusive communications to customers is strictly prohibited.
- KitchenZap reserves the right to suspend platform access or disconnect third-party channel integrations if spam complaints, fraud, or terms violations are detected.
4. Account Termination & Jurisdiction
Either party may terminate platform access at any time in accordance with these Terms. These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the jurisdiction of the competent courts located in New Delhi, India.
